GENERAL TERMS AND CONDITIONS OF SALE Dream Animal & Ode to My Pet & Ready-to-Ship Sculptures

Article 1 — Purpose
These General Terms and Conditions of Sale govern all orders for custom papier-mâché sculptures placed with [Artist's name], a visual artist operating under the French micro BNC regime, based in Dijon, France, under two distinct offers : Dream Animal (decorative sculptures for hospitality and restaurant professionals) and Ode to My Pet (personalised pet sculptures). Placing an order constitutes full and unreserved acceptance of these Terms.
Article 2 — Orders and Quotes for "Dream Animal" & "Ode to My Pet" services
As each sculpture is a unique, made-to-order work of art, no order is confirmed without a prior written quote, issued following an exchange by videoconference — not exceeding one hour — or by detailed email. The quote specifies the nature of the work, indicative dimensions, personalised elements, estimated number of working hours, total price, production timeline and delivery terms. The order is deemed firm upon receipt of the signed quote and payment of the deposit.
Article 3 — Pricing of services for "Dream Animal" & "Ode to My Pet" services
All prices are expressed in euros, inclusive of applicable taxes. Pricing is determined primarily by the number of working hours required, communicated transparently on every quote.
For Ode to My Pet :

Dogs and cats : from €800

Larger animals (horses, etc.) : a supplement applies, communicated on quote or by email

Additional accessory or symbolic element : from €100 depending on complexity

Secondary animal accompanying the main subject (bird, butterfly, etc.) : from €200 depending on complexity
For Dream Animal : between €2,000 and €5,000 depending on size and complexity.
The choice between a wall sculpture and a sculpture on a wooden stand does not affect the price. Shipping costs are listed separately in the quote and are borne by the client.​

Article 4 — Formats and Dimensions for "Dream Animal" & "Ode to My Pet" services
Sculptures are primarily created as trophies or busts. For birds, fish and marine mammals, a full-body sculpture may be offered depending on technical feasibility. Dimensions indicated on the quote are approximate, with a tolerance of plus or minus 5 centimetres in height, width and length, inherent to the handcrafted nature of the work.

Article 5 — Order of Ready-to-Purchase Sculptures
In addition to bespoke commissions, a selection of sculptures is available for immediate purchase through the Shop section of the website. These works are offered for sale as-is, with no modifications possible. Their price and dimensions are clearly indicated on the website. The order is confirmed upon receipt of full payment. As these works are not made to order, the 14-day right of withdrawal applies in full, in accordance with applicable European consumer law, from the date of receipt of the parcel by the client. To exercise this right, the client must notify the artist by email within this period. Return shipping costs are borne by the client. The work must be returned in its original packaging or equivalent protective packaging, in perfect condition. Reimbursement will be processed within 14 working days of receipt of the returned work.

Article 6 — Availability of Ready-to-Purchase Sculptures
Sculptures listed in the Shop section are available subject to stock availability. Should a work become unavailable after an order has been confirmed and payment received, the client will be informed as promptly as possible and refunded in full within 14 working days.

Article 7 — Payment Terms
For "Dream Animal" & "Ode to My Pet" services, a deposit of 50% of the total amount is required upon order confirmation. The remaining balance of 50% is due upon delivery, prior to shipment. For all Ready-to-Purchase Sculptures, payments need to be made in full at the date of order. Payments are accepted by bank transfer or via the secure payment platforms indicated on the quote. Any delay in payment of the balance will suspend shipment of the work.

Article 8 — Right of Withdrawal
In accordance with applicable European consumer law, the 14-day right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised. As Dream Animal and Ode to My Pet sculptures are entirely bespoke works, no right of withdrawal may be exercised once production has commenced.

Article 9 — Cancellation and Refund Policy
Should the client cancel their order before production has begun, the deposit will be refunded in full within 14 working days. Once production has commenced, the deposit is retained in its entirety, regardless of the stage of completion, as compensation for the work undertaken and materials used. Cancellations must be submitted in writing to the following email address: contact@mathildeblum.com.

Article 10 — Likeness and Acceptance of the Work
Each sculpture is crafted as faithfully as possible to the animal, within the limits of the artist's capabilities and the quality of the photographs and videos provided by the client. The likeness of the work is directly dependent on the quality and variety of the visual materials submitted. Clients are encouraged to provide clear, varied and representative photographs of their animal. Accordingly, no request for return, refund or major modification may be made on the grounds that the work does not meet the client's subjective expectations, provided the sculpture has been executed in accordance with the materials provided and the terms of the validated quote.

Article 11 — Use of Photographs and Discount
Photographs submitted by the client are used solely for the purpose of creating the commissioned sculpture. Any other use — including publication on social media, portfolio, press or website — is subject to the client's explicit written consent, requested on a case-by-case basis.
In exchange for granting this authorisation, a discount of €50 is applied to the total order amount. This compensation is stated on the quote and formalised through a separate authorisation document. In accordance with the GDPR, the client retains the right at any time to request the removal of their photographs and sculpture visuals from the artist's communication channels. This right of withdrawal does not entitle the client to reimbursement of the discount already granted, as it was given in exchange for a valid authorisation at the time of its issue.
Article 12 — Copyright and Intellectual Property
All sculptures created are original works of art protected under French and international intellectual property law. The artist retains full moral rights over each piece. The client acquires physical ownership of the work, without any transfer of reproduction or commercial exploitation rights. The artist reserves the right to photograph and document the work prior to delivery, subject to the provisions of Article 9.
Article 13 — Delivery and Liability for Damage
Sculptures are shipped worldwide. Each work is carefully wrapped in bubble wrap, with the parcel filled with paper padding to absorb any impact during transit. The artist accepts no liability for damage occurring after the parcel has been handed to the carrier. The client is responsible for inspecting the parcel upon receipt and filing any claim with the carrier within the legally applicable timeframe. In the event of damage discovered upon opening, the client must notify the artist by email within 48 hours of receipt, including supporting photographs. The artist undertakes to review each situation with care and to seek an amicable resolution.
Article 14 — Disputes and Jurisdiction
These Terms are governed by French law. In the event of a dispute, an amicable resolution will be sought as a priority. Failing agreement, the dispute will be brought before the competent courts of Dijon, unless mandatory legal provisions applicable to consumers residing in another EU Member State provide otherwise.
